Summary information on some of the regulations
(The information below is provided as a convenience to interested parties, it is highly recommended that the actual regulations be viewed, as the information contained below is a non-expert summary.  Links to the current regulations are provided)

General Information
Many regulations apply to child care providers, however the number of child care providers to number of children requirement, the education/experience requirements of the staff and the physical space requirements have the most impact on the cost of establishing and maintaining a child care environment.  These requirements for Pennsylvania are summarized below, with links to the detailed requirement.  

New Jersey requires all providers and staff to submit to child abuse and criminal history clearances.  In most instances persons with a felony convictions will not be approved to run/work-in a child care facility.

Type of Child Care
The child care market in New Jersey allows for two types of child care settings outside a child’s home.

Family Careallows a person to care for a maximum of 5 "outside" children with a total of 8 children at one time under the age of 6.  If more than 5 children, under the age of 6, are in care, they must be children residing with the provider or residing with support child care staff and if they are the children of staff they can only be in care when the supporting staff is at the residence.   If more than 8 children are in care, at any time, Child Care Center rules apply.   Click here to see the New Jersey Regulation on maximum number of children in a Family care environment.

Family Care provider's must be at least 18 years of age, be of good character, have sufficient physical, mental and emotional health to care for children placed in home, reside in the home and demonstrate to the satisfaction of the sponsoring organization and the Bureau, that all applicable requirements of the Manual of Requirements are being complied with.  Click here to see the New Jersey Family Provider Eligibility regulation.  

Family day care providers must be registered with the state and shall be monitored at least once every two years by the sponsoring organization.  Click here to see the New Jersey Monitoring of Family day care providers regulation.

Center Care – allows care for 6 or more children in a residential or nonresidential setting. The maximum number of children in care is determined by the size of the "center". Center based care is regulated and checked by inspectors at least every two years, has a complaint and follow-up system. Regulations control the amount of space per child, provider/child ratios, staff education requirements, immunization of staff and children and many other health and safety issues.
